Chicago Cat Lady Sues Condo Owner - Chicago Real Estate

It?s a story too strange to be anything but the truth?

Chicago cat owner and senior citizen, Barbara Myers, has been in a legal battle with the owners of the Condominiums of Edelweiss for more than three years now.?According to reporter Jack Bouboushian of the Courthouse News, ?In 2008, Condominiums of Edelweiss discovered that Barbara Myers had a cat in her unit, in violation of its no-pet policy. She had kept the cat in her apartment for 11 years without any complaints, but Condominiums demanded its removal and threatened Myers with eviction.?

?Myers responded with a letter from her doctor stating that she needed the cat to help with her various mental and emotional illnesses, making it medically necessary under the Americans with Disabilities Act.?

Condominiums then demanded that Myer?s plead her case in court. Interestingly enough, though, the court found that ?Myers? need for the cat outweighed any harm suffered by Condominiums.?

Myers didn?t claim any damages at the time of her first court appearance, but she subsequently decided to sue Condominiums for violating the Fair Housing Act (FHA) by inflicting emotional distress on her and insisting that she remove her cat from the premises of the condo.

Today, Myers and Condominiums continue to argue their cases, though neither party seems to have much chance of success. Most likely, a judge will rule that although Myers ought to be allowed to keep her cat in her condo, she isn?t owned any money by Condominiums for emotional distress.

In the meantime, Myers will continue to keep her cat in her condo, and the Condominiums of Edelweiss will continue to?well, to let her.
